Sean Carby Cross-Examination:
"We started playing dominoes about8:30 p.m. or 9:00 p.m. The other boys were not at my house beforethat. My back yard faces away from the defendant's house and mysofa was in that yard. To leave that yard one has to go aroundthe house. I was not charged for possession of an unlicensed firearm.
"When the police found the gun, I wentto the Police Station and told them I knew nothing. I don't knowif they believed me, they just let me go. The defendant was notin prison when he was playing football with us. I am not lying.I don't know when he was taken into custody. I am not lying. WhenI saw the .22 rifle Duke or James was not there. I didn't examinethe rifle. I saw it from a close distance. What I am saying isthe truth. It was not my gun as suggested."
That was the testimony of Sean Carby. Hewas caught lying in Court because I was in prison when he saidthat I was playing football with him in West Bay. His testimonywas rejected by the judge and thrown out. This is something thepublic did not know because it was not published in the newspaper.Why? Sean is the son of Bertley and his family did not like oursbecause they thought Mommy had taken their father away from theirmother, causing her pain.
There were rumours about the gun that wasmissing from Miss Che Che's the gun that I had thrown ina pond with the rifle after Jeff and Mike had returned them tomy hiding place. I knew nothing about the gun he said he saw mewith. I knew nothing of what Sean Carby said against me. The pointis his testimony was thrown out of court. He lied. Thank you Judge.
P.W. 18 Rob Benchly (Sworn)
Testimony In Chief
"I am 35 years old, I live at WestBay. I have lived there about 18 years. I knew the defendant,Philip Ebanks. Before 1982 from about 1979 or 1980, I recallwhen Miss Che Che was killed. I had a conversation with the defendantbefore she was killed. About three weeks I was asked by him ifI knew where he could get some shots.
I said I didn't know, but I would ask around.He asked me if I could get him .22 shots. I didn't do anythingright off but I was asked again by Philip. Then I asked a personand I got some shots which I delivered to Philip. I asked theperson for .22 shots; it was either 5 or 6 shots I got. I gotthem at Club Inferno, West Bay and gave them to Philip down at'the land'. They was wrapped in a piece of paper toweling.
"I gave them to Philip about two weeksbefore Miss Che Che was killed. I gave a statement to police inDecember, I was not questioned before that. I didn't see any reasonfor me to come forward before that. The defendant and I used tospeak occasionally after I gave him the shots."
Cross Examination
"I have never seen the defendant witha gun. I do not know what happened to the shots after I gave themto Philip. I never examined them when I had them for make or colouror anything. I never told anybody I got involved with this casebecause of Mr. Summer, James Summer. He is not a friend, onlyan acquaintance."
That was the testimony of Rob Benchly. Hewas correct in saying that I got shots from him but he lied aboutthe date. He gave me shots in October 1982 but I never made enquiriesto obtain shots to shoot someone with, for God sakes. There wereabout seven more guys who could have said the same thing Rob hadsaid. The judge put it how he wanted to and said that it showedthat I had a gun and made inquiries for shots to shoot someone.
What could I do? Stand up in court and say,Sir, I did obtain shots from Rob but not to commit murder sirbut to go shooting in the bush." He would have taken thatas an admission to owning a gun and from there he would pass myexplanation off by saying that I was trying to lie my way outof a bad situation. So I had to say nothing and let the case goon.
P.W. 16 Simon Coldwater (Sworn)
Testimony In Chief
"I am a fisherman and have lived allmy life in West Bay. I know the defendant, Philip Ebanks. I alsoknow Mike Mighty and Jeff Cussler. I have known all three allmy life. I am a little older than them. I knew Miss Che Che, thedeceased. I remember the time of her death, Sunday, 12 December1982. That night I was at Sean Carby's house playing dominos withhim, Duke Fox and Mike Mighty. Philip Ebanks, the defendant camethere. I can't recall the time but it may have been 12:30 a.m.or 1:00 a.m.
"Just before they came I heard a shotfired off. They came and asked for a light. The shot sounded asif it was 100 or 200 yards away; it is about 3/4 to 1 mile fromwhere we were to Miss Che Che's place. After they got the lightPhilip Ebanks, Mike Mighty and Jeff Cussler left. Before theyleft Mike Mighty and Jeff Cussler called Philip Ebanks to oneside and they talked. After they left we continued playing dominos.We turned in between 2:30 a.m. and 3:00 a.m. I did not see eitherof those three persons again for the night.
"Next morning my mother told me something,I was then on my porch. Then I saw Duke Fox come right into myyard. We spoke together, after two police cars drove into 'theland', a road off Water Course Road. After the two cars droveround the back of his house he came out the front door and cameto the back of my house. Duke and I walked where he had stopped.
"I asked Philip if he went to BosinBay the night before and he told me that Mike, Jeff and he hadbeen to Bosin Bay. He told me they went to Che Che house and theyhad to shoot her because she had a gun. He told me they had takenout panes of the bathroom window. She walked into the bathroomand said to them "You must come in here tonight, I have somethingfor you" or words like that, that she had come to the bathroomwindow looking out and they/he had shot her twice from the outside.
"At that time the police cars was drivenback out of 'the land'. He left and went to his house and I wentto mine. During that conversation I can't recall saying anything.I did not tell the police of this at that time as I didn't wantto get involved."
