Grand Court rules in favourof Ritz

The Grand Court of the Cayman Islands onWednesday, December 13, handed down its decision in the appealby the National Trust and Burns Conolly with respect to the grantingof planning permission for the golf course part of the proposedRitz Carlton Grand Cayman Resort, according to a press releasefrom the attorneys representing the developers.

The decision was a victory for the developers of the Ritz projectas the Court clarified that the hotel and condominium part ofthe development, that is, the part west of the proposed by-passroad, can proceed without challenge.

With respect to the golf course portion of the development, thatis, the part east of the proposed by-pass road, the Court decidedthat, after giving the National Trust and Mr Conolly 21 days tocomment on the developers environmental reports, the Central PlanningAuthority (CPA) must meet to decided whether to grant planningpermission in accordance with the 1977 Development Plan.

The developers are pleased with the Court's decision, as theyhad already provided environmental reports as required of theCPA by March 16, 1998 and in June 1999, provided a subsequentdetailed environmental overview as required by the Authority.

The developers said that they are looking forward to meeting thecriteria of the CPA "for the benefit of the Cayman Islands."
