‘Lifer’ loses appeal to Privy Council

The Attorney General’s Chambers has confirmed that Kurt Fabian Ebanks who had appealed his murder conviction to the UK Privy Council was unsuccessful in his appeal. Ebanks is serving a life sentence at Her Majesty’s Prison in Northward.
The UK Privy Council on Monday, 27 March 2006 dismissed Ebanks’ appeal by a 3-2 majority.
He had appealed on the grounds that he had been denied a fair trial by reason of the conduct of counsel who represented him at the trial.
In dismissing this appeal, the Privy Council ruled that there is no basis for holding that Ebanks’ defence counsel acted improperly. On the contrary, the record suggests, as the judge considered, that like the other counsel St John Stevens had paid diligent attention to the preparation of Ebanks’ case.
The Grand Court convicted Ebanks, along with Brian Powell, on 26 January 2001 for the murder of Curtis Seymour. They were subsequently unsuccessful in their appeal to the Cayman Islands Court of Appeal in April 2002.
Additionally, Kenneth Richards, who was convicted for the murder of William Myles in the course of a robbery in May 2000, recently lost his bid to have his appeal heard by the Privy Council. He had applied for special leave to appeal to the Privy Council. On 5 December 2005, the UK Privy Council refused him leave.
